The House’s ELD Mandate Delay Bill Fails

 

The ELD mandate has been a whirlwind of legislations and appeals since its introduction in 2015. The mandate has experienced major pushback from many organizations including the Owner-Operator Independent Drivers Association (OOIDA), which had been spearheading a lawsuit against the mandate and with a request to delay the ELD mandate since March. However, the Supreme Court ultimately denied the appeal back in June.

Many drivers and influential people in the trucking industry still had hope, though. In fact, a recent Facebook poll we conducted showed that 21% of drivers were planning on waiting until December to begin exploring compliance options, with many expressing that they wanted to ride it out and see what happened in court before purchasing.

 

Then, in July, a bill was introduced by U.S. Representative Brian Babin to delay the ELD implementation deadline two years. The goal was to allow more time for fleets and owner-operators to implement electronic logging devices and to help ease the technological and financial burden. While the bill gained a decent amount of traction, it was defeated on September 6.

The American Trucking Associations (ATA), which has long supported the ELD mandate, was quick to respond. “ATA has supported, and will support, this important regulation,” said ATA President and CEO Chris Spear. “Congress has now voted a fourth time to move forward with electronic logging of the existing Hours of Service information required for decades. Make no mistake, the time for debate about electronic logging is over, and we’re pleased that Congress has rejected this ill-conceived effort to delay their implementation.”

Next Steps

With less than four months to go until the December 18th ELD mandate deadline, and no delay in sight, time is running out to get compliant. Congress has now rejected all four appeals to the mandate, and there is no sign of any other legal actions against the mandate being successful. And, with a possible ELD shortage on the horizon, the time for drivers to start the compliance process is now.
